Positive example
ExpiredRecently one magistrate in Sombor has by sentencing authorized power representative with penalty, done something which should be stated as exception, because the absolute precedents always deserve public attention. The decision passed in the procedure in front of Sombor Magistrate and the declared sentence represent absolutely the first case that someone in Serbia is punished for breaching the right of free access to information of public interest. Sombor case gives us hope that we are maybe in the beginning of the new, more qualitative phase in Law preparation, where the right to free access to information shall be protected also by sanctions.
Otherwise, transgression procedure in Sombor has been initiated based on the request of the injured party, one local non-governmental organization, not on request of the authorized body in power, which is a good reason to remind us that in the two year long Law implementation several thousand infringements have been perpetrated, but that there is no single example that the Ministry in charge in the Government of Serbia has started the transgression procedure. Maybe it is time for precedent in that sense, as well.
