Is the Commissioner in charge of realizing information of public importance relating to the work of a government body? (August 2005)
Answer:
The Law on Free Access to Information of Public Importance («Official Gazette of the RS» No. 120/04) regulates the procedure for exercising right of access to information of public importance the government body dispose of.
An applicant, according to the Art. 15 of this Law, files his request directly with the government body which holds information and renders decisions on submitted requests. The Commissioner decides on the appeal of the applicant if the government body refuses to inform the applicant whether it holds particular information or whether such information is available to it, when refuses to enable an insight into the document containing requested information, to release or send to the applicant a copy of the document required, or if it fails to do so within the set time-limit.
