Commissioner for Information of public interest and the protection of personal data sent to the addresses of all higher education institutions in the letter which warned of the obligations relating to proactive disclosure of information about the work. Commissioner warned that all of these institutions, according to the Law on Free Access to Public Information has the obligation to publish the paper on their electronic presentations and that the failure to perform such obligations represents punishable offense.
Assessing the status of the performance of these duties completely unsatisfactory the Commissioner urged the deans and directors of these institutions to execute mentioned legal liabilities without delay.
In this context the Commissioner Rodoljub Šabić stated the following:
„Disclosure of Directory on official electronic presentations with appropriate and regular updated content is the obligation specified under the Law and the relevant instructions on creating and releasing Information on the state autority, that the Commissioner issued under the Law. This obligation applies to public and private institutions of higher education, either by virtue of the fact that they were established by the State, either by virtue of the fact that the holders of public powers.
The current state of Directory of these institutions is striking. Less than ten faculties and colleges have published Informants and almost only those who have done it upon intervention of the Commissioner, after the complaints received of journalists, citizens and students. If we add to this the fact that the Commissioner received so far about three hundred complaints of denial of information against the university, college or high school, most of which should be published in the Informer, this gives a more realistic, disturbing picture of the attitude toward law.
Even the non-publication of the Informant is not punishable, higher education institutions would have to make every effort to change their attitude towards the work. The faster, better and more current information on the publication of the work, especially on the use of public and student money and resources, is the best way to higher education institutions contribute to the affirmation of the idea of transparency as an efficient mechanism to fight corruption at all levels, as well as its own reputation and authority."
