The Commissioner for Information of Public Importance and Personal Data Protection has initiated the supervision procedure over the implementation and imposing of the Personal Data Protection Act by the public communications networks and services' operators.
The supervision procedure shall cover all public communication networks' operators, in total 462 of them, as recorded in the records of the Republic Agency for Electronic Communications, to whom a questionnaire has been sent, on which they shall have to reply within 30 days from the date of receiving it.
In relation to that, the Commissioner Rodoljub Sabic has stated the following:
„The objective of the supervision action is to secure a picture, as reliable as possible, about the actions with personal data in the field of e-communications, i.e. regarding the method and the degree of exercising the constitutionally guaranteed right of the citizens to have the data protected in this field, especially in relation to the Internet based communication.
Accordingly, the questions from the questionnaire pertain to executing the legal obligations by the operators, regarding undertaking technical, human resources and organizational measures for personal data protection, their destroying and especially, of unauthorized access.
Only the first phase of the supervision procedure is in writing, and after that, primarily depending on the contents and the quality of answers from the questionnaire, the authorized persons of the Commissioner shall also implement direct supervision.
I would like to be proven wrong, but I think that we don't have any reason for optimism regarding the state of affairs that would be revealed based on supervision. It is not realistic to expect better results than the ones indicated by the supervision action which the authorized persons of the Commissioner have implemented over the mobile telephony operators a year and a half ago, and which were worrying.
Of course, if that means, and most probably it means, that we are also facing violation of guaranteed human rights on the Internet in serious proportions, that is a reason more to face it as soon as possible and to start changing that situation.
After ending the supervision procedure a special report shall be compiled, which shall be delivered to the persons in charge, and made available to the public."
