COMMISSIONER
FOR INFORMATION OF PUBLIC IMPORTANCE AND PERSONAL DATA PROTECTION

slobodno-pitajIn his letter addressed to the Republic Broadcasting Agency, the Commissioner for Information of Public Importance and Personal Data Protection notedit would be necessary, commendable and useful that the Republic Broadcasting Agency issue a public announcement to clear up all dilemmas that have emerged in the publicregarding the current suspension of broadcasts of cable channels by some operators and invited this Agency to do so.

In that regard, Commissioner RodoljubSabic also said the following:

"Some operators claimed that they temporary suspended cable programming broadcasts "in accordance with the instructions received from the Republic Broadcasting Agency" and used this as an "explanation" for the public and their users.

For many users such "explanation" is unacceptable for many reasons. They cannot see a valid legal basis for such action or, more importantly, the factual reasons which would justify it since it is quite obvious that most of the cable programs (documentary, educational, history, news...) are in no way contrary to the recommendation of the Republic Broadcasting Agency.

Many people thus saw thismove by the operators also as an unjustified denial of information and violation of contractual relations, i.e. failure to provide contracted services they pay for.

To my knowledge, which has also been confirmed in direct talks with some of the members of the Council of the Republic Broadcasting Agency, the "explanation" offered by these operators is not true.

The recommendation of the Republic Broadcasting Agency within its legal powers could include, and I am sure that it did, the need to organize and broadcast appropriate programmingin line with the Government's decision to declare three days of mourning in the Republic of Serbia and appropriate for the mourning atmosphere caused by thetragic events and it could in no way include cancellingof complete programs."
