In the course of February and March 2015, Commissioner for Information of Public Importance and Personal Data Protection analyzed the information booklets of public enterprises and companies vested with public powers (which therefore constitute "public authorities" within the meaning of the Law on Free Access to Information of Public Importance), which makes 24 entities in total.
Based on that, Commissioner has estimated compliance with the legal obligation to publish information booklets, which are to contain all the information provided for under the Law and the Instructions for the Preparation and Publication of Information Booklets, to be completely unsatisfactory, both in terms of quality of information published, and in terms of being-up-to date.
In this regard Commissioner has stated the following:
"Of the 24 controlled entities, 4 (AD Serbian Railways, PE Jugoimport SDPR, PE Institute for Textbooks and PE National Park Kopaonik) have not published information booklets on their official websites at all.
However, none of the remaining 20 entities have the Information Booklet which would be fully compliant with the Law and the Instructions. The published data is mostly outdated, and it has not been updated, and even clear indications that ''updating'' is often performed only by changing the date and not by actual updating of the document have been observed.
None of the 24 entities have presented the data on revenues and expenditures for the current year - 2015, and only 2 of them presented the data for the previous year - 2014.
None of the entities have presented the public procurement plan for the current year – 2015, and ''it figures'' that they have not presented the data on its implementation as well, and only three companies have presented the complete data (the plan of public procurements and its implementation), and 2 more have presented just the plan without the data on implemented public procurement procedures for the previous year - 2014.
In addition, the data on paid salaries, wages and other income has not been presented in accordance with the Instruction. Instead of presenting individual data for managers and employees per certain categories, per the balance for the previous month; average salaries at the level of the whole company, outdated data for managers' salaries and so on have been presented.
Even though the majority of declarations requested from the companies contain formal assurances of the readiness to remedy the deficiencies, their content nevertheless indicates the lack of understanding of the statutory obligation and an unwillingness to comply with it. Commissioner will therefore continue to conduct oversight and issue formal rulings ordering the companies to publish the Information Booklet in the prescribed form, and after that request the line ministry to institute misdemeanor proceedings against responsible persons."
