Commissioner for Information of Public Importance, Rodoljub Sabic, evaluates that persistent breach of law, pertaining to medical documents of tragically diseased patient by Health Center „Studenica" from Kraljevo, is extremely puzzling. The Commissioner considers that by actions of Health Center „Studenica" they grossly infringe the law and rights of the family of diseased patient, the rights stipulated by the laws and also by the decision of the authority in charge, and invites the Government of Serbia and the other authorities to undertake adequate measures.
Pertaining to that, the Commissioner Rodoljub Sabic also stated the following:
„Until today Health Center „Studenica" from Kraljevo still didn't submit the requested copies of documents to the spouse of tragically diseased Andjelka Popovic.
Decision of the Commissioner for Information, ordering submittal of documents is obliging for them, according to the law, but despite of that the Health Center management still evades doing so.
If I would have at my disposal any possibility to use a penalty or other similar method for securing execution of this decision, I would surely do so. However, I don't have such a possibility at hand, and the Government of Serbia, which has a legal obligation in the case of need to secure execution of the decision, and which unfortunately has never so far done that, is still insisting on that completely unprincipled attitude. I have repeated several times, and I would also say now, that with such a relationship it actually invites people to infringe the law and contributes to imploding of the legal authority and of the institutions.
Otherwise, the Minister of Health, T. Milosavljevic has personally promised me that the Commissioner's order shall be executed without delay. He repeated the same promise also to the Citizens' Protector, Sasa Jankovic. Was it that the Minister did not want to or he couldn't fulfill his promise - that is a question for him. The public already contemplates with doubts that the death of Andjelka Popovic resulted as a consequence of a professional mistake. Independently from the fact in what measure such doubts are grounded, the management of the Health Center, and the people in the Ministry of Health would have to know that such persistence in their illegal coverage of documents is strongly undermining them. In relation to that, it is especially worrying that the spouse of the late Andjelka Popovic has been offered after my public appearance, to receive the copies of requested documents, pending however, that he signs he won't „abuse" them.
Striving to help that man in exercising the rights he has, both according to the Law on Free Access to Information and according to the Law on Personal Data Protection, I would request from the Citizens' Protector and from the Republic Public Prosecutor to undertake adequate disciplinary, but also penalty-judicial measures against responsible persons, due to unconscientious work and possible abuse of official position."
