COMMISSIONER
FOR INFORMATION OF PUBLIC IMPORTANCE AND PERSONAL DATA PROTECTION

01.12.2008.The Commissioner for Information of Public Importance and Personal Data Protection, Rodoljub Sabic spoke to Catherine Marchi-Uhel, the Judges Council Chief of the International Criminal Court for Former Yugoslavia. In relation to that, the Commissioner Rodoljub Šabić stated the following:

‘'The reason of Ms March-Uhel's visit to our country is getting introduced to attitudes of our relevant subjects on the possibilities of establishing information centers of the International Criminal Court for Former Yugoslavia at the territory of former Social Federal Republic of Yugoslavia. Huge amount of documentation of the Hague Tribunal consisting of millions of pages of written material and the tens of thousands of hours of audio video recordings, is very significant from the aspect of freedom of access to information. Taking that as a starting point, in our conversation I have highlighted the necessity of preservation, protection and proper use of the documentation.

I have expressed the opinion that, taking into account different attitudes of the Governments of the interested countries, one should strive to create conditions for the widest possible access to information contained in the Archives of the Tribunal. Of course, it is understood, with securing other legitimate interests (protection of privacy, justified secrecy) to the extent necessary. Thus, this information would be used to promote the actual and future judicial practice, serve as a basis for historical researches and surely contribute to further settlement of quarrels and peace in these parts.

I have also expressed an attitude that it is in the general interest that the Archive is preserved, unique, whole, in one place, and that the access to the information contained therein should be provided, under equal terms, for everyone from the region, be that people or states. For that purpose I have suggested, before all, creating conditions for an adequate, the best possible Internet presentation of available documents.

Focusing on enabling a complete and well-organized electronic access to all documents would ensure the freedom of access to information at short notice, as well as leave enough time to remove the differences and dilemmas that already exist with regards to the possible move of the entire archive on to the territory of Former Yugoslavia and with regards to other similar issues."
