SERIOUS CASE OF COMMON SENSE UNDERESTIMATION

I am writing to you regarding the text of Mr. Zoran Lazarevic, attorney and trustee of ’Dr Milan Jovanovic Batut’ Institute for Public Health, titled „Serious Case of Law Underestimation“, which was published in your publication on February 2nd, 2010.

In his commentary on my article „Torlak and Batut do not provide information of public importance“ published in ’Danas’ on January 15th, 2010, Mr. Lazarevic finds that „mister commissioner should be reminded that according to the law in question (Law on the Free Access to Information of Public Importance) there is a right to being informed and a right to not provide the information requested, and that he, and I emphasize again, the courts behind him, are the ones that determine which one of the two rights are valid on a case-by-case basis“.

GOOD INITIATIVE

Lately the media have been reporting that none of the procedures instituted against political parties for failure to comply with the legal requirement to submit reports on their funding have been completed, that many procedures are now statute-barred and that the same obviously awaits all the remaining procedures. That “news“ is bad, but it is actually not surprising at all, because every day we are witnessing instances of failure to initiate proceedings or allowing cases to become statute-barred when the perpetrators are those in power.

AN INCREASE OF THE USE OF THE RIGHT TO FREE ACCESS TO INFORMATION OF PUBLIC IMPORTANCE IN SERBIAN CITIZENS

Rodoljub Sabic, Commissioner for Information of Public Importance, claims that there is an increase in the number of requests for public information from individuals, the media and political parties
BELGRADE – Serbian citizens are using the right to access information of public importance more and more, but it is necessary to increase observance and implementation of the Law in local communities, it was estimated at a public discussion on control of operation of public administration, yesterday. Rodoljub Sabic, Commissioner for Information of Public Importance and Personal Data Protection, said that that there is an increase in the number of requests for public information from individuals, the media and political parties.

The ugly truth that the fight against corruption is a topic where the gap between the normative and the real is probably best seen has, unfortunately, been confirmed by another example – postponement of implementation of the solutions from the ‘’new’’ Law on Public Procurements.   And the ‘’new’’ Law, which was at the time of its adoption deemed a very important contribution to anticorruption efforts, actually is not new anymore. It came into effect in January last year.

Reaction to the statement of the secret services’ first man 

Ombudsman announces the first control of BIA by the end of January. Mesarovic: The High Council did not in writing or orally request from BIA, or ordered BIA or Ministry of Internal Affairs to deliver any data whatsoever.

Security-Informing Agency did not have order from the High Judiciary Council for collecting data about judges during re-elections - said for „Blic“ Nata Mesarovic, Chairlady of the High Judiciary Council, after explanation of Sasa Vukadinovic, Manager of BIA, that the Agency collects data on persons of special importance for the state, and that data on judiciary authorities’ representatives available to it haven’t been abused and are not in the hands of unauthorized persons.

„TORLAK“ AND „BATUT“ DENY INFORMATION OF PUBLIC IMPORTANCE

Immediately after the New Year to the address of the Commissioner for Information of Public Importance and Personal Data Protection came, from one Belgrade weekly newspaper’s editorial office, two really interesting complaints confirming that our public, at least regarding interest for issues pertaining to hyper-current topic “goes with the European flows”, as “swine flu” pandemics is in global dimensions, that is, AH1N1 virus.
