RODOLjUB SABIC'S VIEW OF THE CONCESSION HORGOS-POZEGA
The Public Information Commissioner Rodoljub Sabic stated yesterday that he expects Serbian Government to make the Concession Contract for Horgos-Pozega highway publicly available, because they are liable to do so according to the Constitution and Law on Free Access to Information of Public Importance. Sabic specified that the Serbian Constitution in its Article 51 guarantees the right of access to information owned by the government, and the Law on Free Access to Information determines and elaborates this right. "All our authorities shall be liable to fully harmonize their behavior, including arrangements with foreign partners, with obligations stemming from our Constitution and the Law. Nowhere in the world, the commercial contracts can penetrate into public and legal order", it was mentioned in the statement. As he pointed out, the Constitution of Serbia provides for that even the ratified inter-state contracts have to be aligned with it. Sabic reminded that one of provisions of the Concession Contract establishes that all information concerning construction and maintenance of the highway shall be confidential, and that the Serbian public may not obtain any information unless allowed by the foreign partner. "This is conflicting with provisions in the Constitution and Law. Such provision renounces provisions of our public and legal order, i.e. makes their application dependable upon free will of foreign partners, which is unacceptable", underlined Sabic.
